1. Definitions
Company: Agrijet Limited trading as Foreman
Customer: The purchaser of goods supplied by the Company
Business Customer: A customer purchasing goods wholly or mainly for business, trade, agricultural, commercial, or industrial use
Consumer: A person acting for purposes wholly or mainly outside their trade, business, craft, or profession, as defined under applicable UK consumer legislation
Goods: Equipment, accessories, components, or products supplied by the Company
2. Contract Formation
No contract shall exist until goods are dispatched by the Company.
The Company reserves the right to refuse or cancel orders prior to dispatch.
3. Pre-Dispatch Technical Confirmation
The Company may require written confirmation from the Customer that the specification, intended application, and delivery requirements have been reviewed and accepted prior to dispatch.
4. Price & Payment
All prices are stated in GBP unless otherwise specified.
Payment is required prior to dispatch unless otherwise agreed in writing.
5. Delivery
Delivery is typically made via pallet courier or specialist transport service.
The Customer is responsible for ensuring suitable and safe delivery access.
Delivery dates are estimates only unless otherwise agreed in writing.
6. Risk & Title
Risk in the goods passes to the Customer upon delivery.
Title to the goods remains with the Company until full payment has been received and cleared.
7. Limitation of Liability
To the maximum extent permitted by law, the Company’s liability shall not exceed the original purchase price of the goods supplied.
The Company shall not be liable for:
- Indirect losses
- Consequential losses
- Loss of earnings
- Downtime
- Business interruption
- Third-party costs
Nothing within these Terms excludes or limits liability where prohibited by applicable law.
8. Warranty
Warranty cover is provided in accordance with the Foreman Warranty & Service Policy.
9. Use
The Customer is responsible for ensuring the equipment is suitable for the intended application and is operated, maintained, and stored safely and competently in accordance with Foreman documentation.
10. Returns
Returns are handled in accordance with the Foreman Delivery & Returns Policy.
A machine is considered “used” once fuel, oil, or water has entered the system.
11. Force Majeure
The Company shall not be liable for delay or failure to perform obligations resulting from events beyond its reasonable control.
12. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.
13. Entire Agreement
These Terms, together with the Warranty & Service Policy and Delivery & Returns Policy, form the entire agreement between the Company and the Customer relating to the sale of goods.
